In order to strengthen the management and the supervision of imported scrap materials, as well as to protect the environmental hygiene and people’s health, and to ensure the safety of industrial and agricultural production, according to the regulations under the <Law of the People’s Republic of China on Import & Export Commodity Inspection>, the AQSIQ has decided to implement management measures on the temporary registration of overseas enterprises exporting scrap materials to China (hereby referred to as “Supply Enterprises”). The requirements for the temporary registration of “Supply Enterprises” are:
1) Starting from January 1, 2004, AQSIQ will accept application for temporary registration of “Supply Enterprises”. From July 1, 2004 onwards, “Supply Enterprises” not temporarily registered with AQSIQ are not allowed to export scrap materials to China. All inspection institutions pre-authorized by AQSIQ are not allowed to accept their applications and issue certificates to them. CIQ at Chinese destination ports will not accept any of their inspection applications.
2) “Supply Enterprises” that satisfy the following conditions may apply for temporary registration:
a. The enterprises operate legally in its country (region).
b. The enterprises have a permanent office or processing place and the operation should be of a considerable size.
c. Familiarize with and has a good knowledge of the requirements and techniques prescribed by the Chinese Environmental Protection Control Standards, and equipped with the basic corresponding facilities and inspection ability.
d. Possess the corresponding quality control system on the inspection of scrap materials or have obtained an accredited certificate in management of environmental quality control.
e. Have a relatively stable source of supply and adopted environmental protection quality control measures over their suppliers.
f. Have no record of involving in serious problems with their exported scrap materials regarding the safety, hygiene and environmental protection quality issues for the last three years.
3) “Supply Enterprises” applying for temporary registration with CIQ should submit the following materials in written:
a. <Application for Registration of Overseas Supply Enterprise Importing Scrap materials> (see attachment I).
b. Company business license (copy).
c. Documents on the environmental quality control system or the accredited certificate in management of environmental quality control.
d. Documents detailing the source of supply materials and the quality control measures taken.
e. A general description of the safety, hygiene, environmental protection and quality of scrap materials shipped to China in the last three years and other relevant documents.
f. Other relevant materials required by the AQSIQ.
All materials submitted to AQSIQ for temporary registration must be either in Chinese or in both Chinese and English.
4) Applicants that satisfy the requirements will be issued a <Notice on Acceptance/Rejection of the Application for Registration of Overseas Supply Enterprise Importing Scrap materials> by AQSIQ (see attachment II). Applicants that do not meet the requirements and are required to submit supplemental materials should be informed at one time to supply the required materials within 5 days. Late submissions will be considered as withdrawal of their applications. Applications that fail to meet the requirements will be rejected and the applicants will be informed of the reasons.
5) Within three months after AQSIQ has issued the < Notice on Acceptance/Rejection of the Application for Registration of Overseas Supply Enterprise Importing Scrap materials >, an examination team will be set up to carry out on-site examination according to the <Regulations on On-Site Examination for Registration of Overseas Supply Enterprise Importing Scrap materials>. In case no on-site examination is required, the team will examine the applicant’s documents. An assessment report will be submitted to AQSIQ by the team.
6) Applicants that satisfy the requirements will be issued a temporary registration certificate with a registration number by the AQSIQ. A letter will be sent to inform applicants whose applications are rejected.
7) The temporary registration certificate is valid for two years. Applicants who want to apply for renewal should submit their applications to AQSIQ within three months before the certificate expires.
8) “Supply Enterprise” need to have the temporary registration certificate in order to apply for pre-shipment inspection with Inspection Institutions. CIQ at Chinese ports accept imported scrap material inspection applications from “Supply Enterprises” that are approved for temporary registration. All inspection institutions pre-authorized by AQSIQ will reject applications from “Supply Enterprises” that are not temporarily registered. If it is found that the scrap materials are not up to standard in the safety, hygiene or environmental protection aspect during the inspection carried out by the CIQ at destination ports, the AQSIQ should be informed of the details of the inspection and the name of the “Supply Enterprise” immediately.
9) If CIQ at destination ports finds that the scrap materials fail to meet the requirements regarding the safety, hygiene and environmental protection regulations and the scrap materials according to law should be returned, the “Supply Enterprise” should cooperate with the relevant Chinese authorities to proceed with the shipment procedures.
10) “Supply Enterprises” applying for temporary registration should provide all necessary assistance to the examination team of the AQSIQ for carrying out the on-site examination.
11) In Hong Kong, Macau and Taiwan region of China, procedures on temporary registration of overseas enterprise exporting scrap materials to China should base on the requirements of this notice.
